DINSTRACTION'S TERMS OF SERVICE FOR COMMISSIONS
By commissioning me you have read through and agreed to the following Terms of Service.
By commissioning me you have read through and agreed to the following Terms of Service.
STATEMENT OF INTENT
• By accepting your commission, I fully intend to create an artwork that you will be happy with! • I equally fully intend to create an artwork I can be proud of, and to have fun working for you. • If I feel something is unclear about your order, I will communicate with you until I feel I have an adequate understanding of what you'd like. • If I feel that I can't produce an artwork you will be happy with, I will decline the commission before starting whenever possible to ensure minimal hassle for all parties involved. • If asked, I will be happy to explain where I'm at in the commission process (so long as this does not turn into micro-managing/nagging!). • Should something change on my part or yours that affects the commission or commission process (payment, delays, change of character design, etc) I will do my best to communicate with you about it! If something happens, don't hesitate to reach out; what solutions or steps will be taken are determined on a case-by-case basis. • The terms below are for clarity and comfort for everyone involved in the transaction; they are not intended as rigid rules and may be flexible depending on the client and the circumstances around the commission process. |
CONTENT
• Content that I will not draw: ↳ Explicitly sexual/pornographic scenes ↳ Excessive gore ↳ Any content that promotes hate or violence towards any group of people ↳ Romantic relationships between minors and adults, including characters that have the appearance of minors even if they canonically aren't ↳ Copyrighted characters (Nintendo, Looney Tunes, Disney etc) - fandom OCs are okay! ↳ Real people (celebrities, youtubers etc) - friends/family are okay! • I reserve the right to refuse a commission for any reason, including content, theme, character design, or client behavior. • I reserve the right to not have to give an explanation for refusing a commission. • The client must be able to provide a visual reference of their character(s) or a detailed written description. • The client is responsible for detailing any and all information regarding their character's appearance and other details in their commission. If they do not tell me what they want I will take artistic liberty. I do not take responsibility if the client is unhappy with a finished commission due to negligence on delivering commission details on their part. |
THE PROCESS, REVISIONS, AND ALTERNATE VERSIONS
• The client will be sent a preliminary sketch by email/note for them to change or approve. • Major revisions can only be made during the sketching phase. Once the sketch is approved, no further revisions to the lineart, composition, or related elements can be made. • Certain products do not have a sketch approval phase and the client will only receive the final product. The client will be informed before work starts if a sketch approval is included or not. • Revisions to color/markings/etc on the character can be made until the commission is finalized. • Excessive amounts of edits or changes to the commission that significantly lengthen the time spent on production will incur additional fees. • Alternate versions are allowed on a case by cases basis and may incur an additional fee depending on the complexity of the difference. • I do not work within strict deadlines. I take my time to produce a quality commission rather than stress out a sub-par product. ↳ If the client does have a deadline they want me to meet (for example if the commission is a birthday gift), the commission can be prioritised for an additional fee depending on the complexity of the artwork and/or how soon the deadline is, assuming I deem it possible to meet the deadline in the first place. • Once the commission is done, the client receives the full size file without a watermark. If the commission is for a painting, they will also receive a resized version with watermark for display on the web. |
PRICE AND PAYMENT
• Price is decided on a case-by-case basis. The prices specified in the price list are estimates that can and will wary depending on desired quality and complexity of the commission. Things that can increase the price include but are not limited to complex character designs (markings, wings, extra limbs, clothing etc), complex perspective, detailed backgrounds, props, etc. • Payment is made through PayPal. Payment is expected before starting the commission, at least 50% of which must be paid upfront. Full payment is expected upfront for commissions valued at 50€ and under. • Payment via Swish is acceptable if you have access to it. • If I or the client chooses to terminate a commission, a refund will be issued for any work that has been paid for that hasn't been rendered yet. • Finished works are non-refundable. |
RIGHTS
• The client retains all applicable rights to their IP, characters and ideas. • I retain all rights to the finished artwork and all stages/WIPs leading up to the finished artwork, which includes the right to redistribute and use the work in self-promotion. • Clients are not permitted, under any circumstances, to use any part of the commissioned artwork (including WIPs) in any blockchain related technology, including but not limited to NFTs, cryptocurrency or future inventions in that space. Use of the artwork for any advertising or profits associated with this technology is strictly prohibited. • If you do not want your commission to be made public, an additional charge will be applied. This charge will be decided on a case-by-case basis. • You can request to be anonymous at no extra cost. • Finished commissions are for personal use only. The client is allowed to post and display the finished image to their own personal galleries/collection/social networks, as long as they leave proper credit, and use it for personal, non-commercial purposes only. • Works commissioned for non-commercial use can be cropped to accommodate personal uses such as user icons or forum signatures as long as credit to the artist is maintained. • The client may not use the finished artwork or any WIPs for any commerical use or monetary gain or claim it as their own creation. The client may not reproduce my creations en masse with intention to sell/profit. • Clients lose any and all rights to works that are canceled/refunded. • If you wish to commission or use my art commerically, I am willing to discuss licensing it. |
